Skills Development, Learnerships and Training

Businesses with an annual payroll of R500 000 annually are required to pay 1% of their payroll in Skills Development Levies (SDL) to SARS monthly. By submitting an Annual Training Report and Workplace Skills Plan to the relevant SETA (Sector Education Training Authority), these businesses are eligible to claim back 20% of the SDL paid in mandatory grants, which can be used to upskill and further develop their employees.
But skills development is about so much more than just completing these submissions. Developing a skills matrix, linked to employee evaluations, companies can target actual training needs of their employees, which not only motivates employees, but ensures the business itself benefits from upskilled employees who use newly acquired learning experiences to perform the duties more effectively and become eligible for promotion, thereby retaining advanced skills within the business.

NY Consulting can assist businesses with annual submissions, accessing additional discretionary grants from the SETA, implementing and managing Learnerships and providing a host of training, from mandatory Health and Safety training to various soft skills.

Employment Equity

The Employment Equity Act applies to all employers and aims to protect employees and job seekers from unfair discrimination through the implementation of Affirmative Action measures.

Currently, employers with 50 or more employees or more, who are above the annual turnover threshold set by the Department of Labour, are designated employers and are required to submit annual reports to Department of Labour.
In addition to these annual submissions, designated employers are required to comply with all provisions of the Act, including Employment Equity training, creation of a committee who meet quarterly, as well as the preparation and maintenance of a company Employment Equity Plan.

As consultants we guide our clients through the maze of the Employment Equity Act, providing advice on affirmative action measures to be taken, ensure all policies and procedures are in place, and annual submissions are completed on time,  to maintain compliance with the Act.

COIDA Assistance

Every employer is required to register with the Compensation Commissioner as soon as the first employee is employed. This insurance provides benefits to employees who may be injured or become ill from a work-related cause. Further to this, it is becoming more frequent that being in ‘good standing ‘ is required by employers when submitting a tender, as well as required as part of their Health Safety file.

We can navigate the online platforms for annual return of earnings submissions, advise you ahead of time regarding the required payment to be made and ensure a letter of good standing is received and is kept current.

Outsourced Human Resources

Human Resources is about the management and development of employees. SMME’s often do not have the budget nor require the amount of attention required to appoint a designated HR individual within the business.

That is where we come in. As an outsourced consultant we can assist with the management and development of employees on an ad hoc basis, or for a set number of hours monthly. You focus on growing your business, and we work towards maintaining, or developing, your company culture, while increasing employee performance.

Struggling with employee discipline? Our consultants chair disciplinaries, providing detailed minutes with the verdict and sanction. In the unfortunate event of a CCMA or retrenchment occurrence, we have the right business partners to tap into for the most favourable outcome.

POPIA Assistance

We are all aware of the POPIA Act and the effective date of 1 July 2021, but how certain are you that your business is complying with the Act.
We take a ‘commonsense’ approach to POPIA compliance and can assist and guide employers on what to put in place as well as educate employees on what to look out for, and how to follow the flow of information through the business to prevent a breach from occurring.

For those who prefer to navigate the POPIA journey themselves, an electronic DIY kit can be provided, which includes templates, policies and a manual that can be adapted to align with your specific business requirements.

Policies and Posters

All employers are required by law to display the Employment Equity Act, Basic Conditions of Employment and Occupational Health and Safety Act posters, in an area where all employees have access to them.
We supply these legislative posters, as and when required, as well as any other poster your industry may call for, including Tobacco Act, Skills Development Act, COIDA Act, POPIA and many more.

Have you ensured that all employees are aware of the company policies and how you as an employer conduct business?
We can assist you with the compilation of an employee handbook, or any other policy your business may require. The policies and handbook are generic and can be adapted to fit with your specific industry requirements.
